These Terms of Service ("Terms") govern your access to and use of the Aqoiy platform, including our website, web applications, WordPress plugin, mobile applications, and API (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.
Aqoiy provides an AI-powered customer support platform for e-commerce stores. The Service includes an AI chatbot plugin that integrates with your online store, a web dashboard for managing conversations and settings, and mobile applications for live agent support.
We use Google Gemini (Vertex AI) to generate AI responses based on your store's product catalog, order data, and policies. Responses are generated automatically. While we strive for accuracy, AI-generated responses may occasionally be incorrect or incomplete.

Aqoiy offers free and paid subscription plans. Paid plans are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.
The free plan includes limited features as described on our pricing page. Free plans may have usage limits (messages per month, number of products, etc.).
Each plan has defined usage limits. If you exceed the limits of your current plan, certain features may be restricted until you upgrade or the next billing cycle begins.
You may cancel your subscription at any time from the dashboard. Upon cancellation, your account will revert to the free plan at the end of your current billing period. No refunds are provided for partial billing periods.
We may change pricing with at least 30 days' notice via email. Continued use of the Service after a price change constitutes acceptance of the new pricing.
You retain ownership of all data you provide to the Service, including your store data, product information, and customer conversations. By using the Service, you grant us a limited license to process this data solely to operate and improve the Service.
We handle your data in accordance with our Privacy Policy. You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consent from your customers.
The Service, including its design, features, code, and documentation, is owned by Aqoiy and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.
The Aqoiy name, logo, and branding are trademarks of Aqoiy. You may not use them without prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated responses will be accurate or appropriate for your specific use case. You are solely responsible for reviewing AI responses and configuring your chatbot appropriately.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AQOIY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Aqoiy, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination:
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
